This Privacy Policy describes the ways in which your personal information is collected and used, and the rights and options available to you with respect to such information. For purposes of this Privacy Policy, the “Platform” shall refer to SSKY’s proprietary cloud-based video creation and management console software and related code, documentation, features, and services, and any changes, enhancements, extensions, adaptations, components, additions, improvements and applications thereto, whether now existing or hereafter devised. ABOUT SUNDAYSKY

SSKY is a pioneer in serving online video ads that are personalized to our customers’ customers. The objective is to present personalized video ads to viewers that express interest in our customers’ websites, as visitors browse the web. The rationale is that by doing that, the advertisements presented are more relevant to viewers. One may see these ads when visiting other websites that publish online video ads. SSKY strongly believes that this approach is beneficial for both our customers and their website visitors as each viewer is presented with the advertising message that will match his or her specific preferences. By doing this, viewers get ads that are more interesting for them, so they are less likely to be annoyed by them and are, as we’ve seen, significantly more likely to engage with them in search for additional information or to take advantage of a specific offer.

It is important to note that the Website may be operated via servers situated in the United States and elsewhere. If you are located outside of the United States, please be aware that any information which you supply to SSKY (including, without limitation, personal information [e.g., your name, phone number, email address, etc.]) may be transferred to, processed, and used in the United States and elsewhere. CONTENT THAT YOU PROVIDE FOR PUBLICATION ON THE WEBSITE

From time to time, SSKY may enable you to post content on its Website (i.e., such content may appear on a blog, in a community forum, etc.), or to provide SSKY with content that SSKY will post. In either scenario, by making available such content to SSKY, you expressly acknowledge, agree and warrant that: (i) such content may be published on the Website; (ii) such content may be used by SSKY in various other capacities and for various purposes as SSKY deems appropriate, including without limitation, improving the Platform and managing complaints; and (iii) such content does not violate any other person’s right to privacy, does not violate any applicable laws, and does not otherwise infringe any other party’s intellectual property rights. INFORMATION GATHERED WHEN USING THE WEBSITE

SSKY may collect information pertaining to your activity on the Website, including content that you create, information or advertisements that you have read, the web pages you visited, offers and Platform-related services that were of interest to you, the location of the computer and the Internet Protocol (IP) address through which you had access to the Website and more. SSKY may sometimes receive information about consumers from third parties to enhance the Website and/or Platform (specifically our video advertising retargeting solution), as well. The collection and use of that data is governed by the privacy policy and legal terms of the applicable third party data collector as well as the website using the data; it is not governed by this Privacy Policy. Additionally, SSKY may collect or use the assistance of third parties to collect and analyze anonymous, statistical or aggregative information related to your use of the Website (and if applicable, the Platform), including information related to your personal details and activities.

We will store the information you provide and the information we collect about your activity on the Website throughout our databases (the “Databases”). We reserve the right to use such information for the following purposes:

• To provide the Website and to enable you to use it;

TRANSFER OF INFORMATION TO THIRD PARTIES

• In any case where SSKY may reasonably believe that sharing information is necessary to prevent serious damage to your person or property or to the person or property of any third party;
• If SSKY organizes the operation of the Platform within a different framework, or through another legal structure or entity, or if SSKY is acquired by, or merged with another entity, provided however, that those entities agree to be bound by the provisions of this Privacy Policy;
• SSKY may share personally identifiable information and information related to your use of the Website, with companies or organizations connected to or affiliated with SSKY, such as subsidiaries, sister-companies, parent companies and service providers such as an email service provider to send you emails on our behalf, with the express provision that their use of such information must comply with this Privacy Policy; or
• SSKY is also entitled to transfer or share anonymous, statistic or aggregative information with companies or organizations connected to SSKY, and with suppliers, business partners, advertisers, and every third party, according to SSKY’s absolute discretion; however, SSKY will not disclose your identity to them, knowingly or deliberately, without receiving your consent.

CHILDREN’S ONLINE PRIVACY INFORMATION

SSKY does not knowingly collect personal information from minors who are under the age of 16 through the Website or the Platform. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without his/her consent, then he or she should contact SSKY at the information described below. If we become aware that a child under the age of 16 has provided us with personally identifiable information, we will delete such information from our files. Further, the Children’s Online Privacy Protection Act (“COPPA”) requires parental consent for collection of data from children younger than the age of 13 years old. A cookie is a small text file that is stored in your web browser that allows SSKY or a third party to recognize you. Cookies might be used for the following purposes: (1) to enable certain functions; (2) to provide analytics; (3) to store your preferences; and (4) to enable ad delivery and behavioral advertising.

We use additional technologies to help track user activities and preferences. For example, we use web beacons (also known as clear gifs, pixel tags or web bugs). Web beacons are tiny graphics (about the size of period) with a unique identifier that are embedded invisibly on web pages or emails. They are used to track user activities and communicate with cookies. You cannot opt out of web beacons used in webpages, but you can limit their use by opting out of the cookies they interact with. The Website includes social media features, such as the Facebook “LIKE” button/icon. SSKY implements data security systems and procedures to secure the information stored on SSKY computer servers. Such systems and procedures reduce the risk of security breaches, but they do not provide absolute security. Therefore, SSKY cannot guarantee that the Website is immune to unauthorized access to the information stored therein and to other information security risks.

ACCESS TO PERSONAL INFORMATION

If your personally identifiable information changes, or if you no longer desire to use and access the Website, you may correct, update, delete/deactivate your information by emailing SSKY via the contact information listed below. We will undertake to respond to your request within 30 days’ of SSKY’s receipt thereof.
